Upstate Web Works (a d/b/a of Bagelcat LLC, a South Carolina limited liability company) respects intellectual property rights and expects our clients and visitors to do the same.

Our role

upstatewebworks.com is the marketing site of Bagelcat LLC, doing business as Upstate Web Works. It does not host user-generated content or third-party uploads. Everything on it is content we produced or licensed.

The restaurant sites we build for clients are handed off to the client on delivery. After handoff, the client is the operator of that site and is responsible for the content displayed on it. We are neither the operator nor the host of the client’s live production site.

If you believe content on upstatewebworks.com infringes your copyright

Send a written notice, in accordance with 17 U.S.C. § 512(c)(3), containing:

1. Your physical or electronic signature.
2. Identification of the copyrighted work you claim has been infringed.
3. Identification of the material that is claimed to be infringing, and the URL(s) where it appears on our site.
4. Your contact information: address, telephone number, and email.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Send the notice to our designated agent:

We respond to complete, good-faith notices within 10 business days.

Counter-notice

If content of yours was taken down and you believe it was in error, you may send a counter-notice under 17 U.S.C. § 512(g)(3) to the same address. Include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and its former location.
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed in error.
4. Your name, address, phone number, and consent to jurisdiction in the federal district court for the District of South Carolina.

Repeat infringers

We terminate our relationship with any client or vendor who is a repeat copyright infringer.

Safe harbor

Where applicable, Bagelcat LLC (d/b/a Upstate Web Works) asserts the online-service-provider safe harbor under the Digital Millennium Copyright Act (17 U.S.C. § 512) for content transmitted, cached, hosted, or linked through the systems we operate.

Client-site takedowns

If you believe content on a site we built (rather than upstatewebworks.com itself) infringes your rights, please contact the operator of that site directly — they are the responsible party post-handoff. If you cannot locate them, email us and we’ll pass the notice along.
